OMYA gets aid in truck conflict

Associated General Contractors of Vermont has come out in support of OMYA Inc. in its battle to overturn a state Environmental Board ruling that restricts the company's truck traffic along Route 7.

AGC, a statewide trade association of building contractors, announced Thursday it would provide financial support for L.F. Carter, the Pittsford trucking company that hauls marble ore for OMYA.

AGC said that it would provide financial assistance and support for Carter when the trucking firm files a motion to intervene in the federal court case next Thursday.

"… The motion papers will argue that the Environmental Board's attempted limitation on OMYA's use of a national highway constitutes an impermissible attempt to regulate in an area that has been pre-empted by the United States Congress," AGC said in its statement.

"AGC strongly believes that the state's contractors and motor carriers should have unrestricted use of the national highways."

OMYA has filed a constitutional challenge to the board's Act 250 ruling in U.S. District Court. However, the lawsuit remains on hold pending its appeal before the state Supreme Court .
